Sec. 12.5-1. Establishment of a public library.
There is hereby established in
the city, a Norfolk Public Library, which shall be kept and maintained as such
by the city. In this chapter the term
"public library" shall be held to mean the Norfolk Public
Library.

Sec. 12.5-2. Library
director; appointment; duties.
The
library director shall be appointed by the city administrator. The library
director shall have the care and custody of the grounds, buildings, rooms,
equipment, books and supplies owned or used by the public library, and the
general supervision thereof.

Sec. 12.5-3. Citizens'
library advisory board--Established.
There is hereby established a
citizens' library advisory board, which board shall have five (5) members. The members of the board shall be chosen at
large from the citizens of the city; provided, however, no member of the city
council shall be a member of such board.

Sec. 12.5-4. Same--Appointment; terms; compensation.
The members of the citizens'
library advisory board shall be appointed by the mayor, with the approval of
the city council. The term of each
member shall be five (5) years, which term shall commence on July 1. One member of the board shall be appointed
each year at the last regular meeting of the city council in the month of
June. In the case of a vacancy, the
mayor shall appoint a replacement, with approval of the city council, for the
unexpired term. The existing terms of
the members of the library board at the time of the passage of this chapter
shall remain in effect. No member of
the citizens' library advisory board shall receive pay or compensation for his
or her services as a member of the board.

Sec. 12.5-5. Same--Delegated Responsibilities.
The Citizens' library advisory
board shall work with the library director, city administrator, mayor and city
council in regard to the development of the public library. The citizens' library advisory board is
hereby delegated the following specific responsibilities:
(1) To advise the library director in the development and implementation
of library policies;
(2) To advise the library director regarding the maintenance and
expansion of the materials collection and programs of the public library;
(3) To advise the library director regarding the preparation of
an annual library budget, which budget shall be prepared by the library
director in the format used by other city departments and divisions, and to
periodically review library claims to ensure budgetary compliance;
(4) To receive citizen input, comments and complaints regarding
the materials collection, programs and services of the public library, and to
report the same to the library director, with recommendations;
(5) To provide such advise or recommendations as may be
specifically requested by the city administrator relative to matters
concerning the public library;
(6) To encourage use of the public library and promote its programs
and services;
(7) To represent the city and public library within professional
associations and at library functions;
(8) The Norfolk Library Foundation shall retain exclusive responsibility
for decisions concerning the expenditures of Norfolk Library Foundation funds
and private donations made to the Norfolk Library Foundation.

Sec. 12.5-6. Same--Bylaws; rules; regulations.
The citizens' library advisory
board may adopt bylaws, rules and regulations for its own guidance as the board
may deem necessary and as such shall not be inconsistent with this
chapter.

Sec. 12.5-7. Custody of
library funds.
The city treasurer shall have
the custody of all tax monies and penalties collected, as well as other funds
acquired for erection, maintenance or support of the public library, including
any donations made to the City of Norfolk for the library. The city treasurer shall not have the
custody of those funds belonging to the Norfolk Library Foundation or those
received by the Norfolk Library Foundation by way of private donation. All monies received by the public library,
exclusive of those funds belonging to the Norfolk Library Foundation, shall be
paid, not less than weekly, to the city treasurer.

Sec. 12.5-8. Penalties
imposed; recovery in civil action.
Penalties imposed or accruing
under any bylaw, rule or regulation adopted by the citizens' library advisory
board or city council may be recovered in a civil action before any court
having jurisdiction thereof. Such
action shall be instituted and maintained in the name of the city. This remedy shall be in addition to that
provided in section 12.5-9.

Sec. 12.5-9. Unlawful Library conduct.
It shall be unlawful for any person to take or retain
possession beyond the due date of, or to remove from the public library
building, in violation of any bylaw, rule or regulation adopted by the
citizens' library advisory board or city council for the protection and
government of the public library or in violation of any agreement entered into
by any person concerning utilization of the public library, or to willfully and
maliciously write upon, deface, injure or destroy any book, periodical, record,
film or other property owned by, or in custody of, the public library. Any person who shall violate the terms of
any agreement concerning utilization of the public library, or who unlawfully
takes or retains possession beyond the due date of, or removes from the public
library building, writes upon, defaces, injures or destroys any book,
periodical, record, film or other property owned by or in the custody of the
public library, shall be guilty of an offense.
